Government Decree No. 79/2004 (IV.19.) on the Conditions for Market Entry of Postal Service
Providers.
These General Terms and Conditions define the Service, the rights and obligations of the Service
Provider and the Customer, their respective liabilities, the conditions under which the Customer
may become acquainted with the liability provisions of the selected Partner (including the
availability of the Partner's General Terms and Conditions), and all other requirements that must
be fulfilled by the Customer to enable the Service Provider to organise the postal transportation of

own or operate transport vehicles and does not employ couriers. Instead, it operates an
information technology platform that enables prospective Customers/Senders to select the

specified by the Customer. The Service Provider participates in the courier transportation process
solely in the capacity of an intermediary.
Any natural person, legal entity or other business organisation that orders a courier service may,

formation of the contractual relationship, the respective responsibilities and liabilities of the

11. Delivery
11.1. The Partners collect Consignments according to their respective collection procedures.
DPD, TNT, FedEx, UPS, GLS and Express One generally collect Consignments by following their
established collection routes from the outer areas of Hungary towards the central regions.
The Customer shall obtain information regarding the applicable collection times from the
Customer Service Department of the selected Partner.
In more remote areas of Hungary, enquiries regarding collection times should be made by 09:00
on the relevant Business Day to enable the Partner to collect the Consignment on the same day.
Remote areas may include locations with postal codes beginning with 3, 4, 5, 6, 7, 8 or 9, which
are generally situated further from the centre of Budapest.
11.2. Unless otherwise provided by the selected service, deliveries shall be carried out on
Business Days during the Partners' normal delivery hours, generally between 08:00 and 18:00.
Each destination country has its own customs and delivery regulations.
Information regarding such regulations may be obtained from the Customer Service Department
of the relevant Partner.11.3. Within the European Union, deliveries are carried out on a door-to-door basis through the
Service Provider's Partners.
Shipments to countries outside the European Union are subject to separate rules and procedures.
Further information may be obtained from the Customer Service Department of the relevant
Partner.
11.4. For domestic shipments and international courier shipments within the European Union, the
Partners shall, at no additional charge, make up to three delivery attempts on separate Business
Days.
Where a delivery attempt is unsuccessful, the courier shall leave a delivery notice at the
Recipient's address.
Following the third unsuccessful delivery attempt, the Partner shall store the Consignment in its
warehouse for a period of five (5) Business Days.
If neither the Recipient nor the Customer claims the Consignment during this period, the Partner
shall, upon expiry of the five (5) Business Days, return the Consignment to the Customer at the
Customer's expense.
In this respect, the applicable Terms and Conditions of Carriage and operational practices of the
relevant Partner shall prevail.
11.5. For shipments to destinations outside the European Union, the foregoing provisions shall
apply mutatis mutandis, provided that, where the Recipient does not claim the Consignment after
the third delivery attempt, the Partner shall retain the Consignment in its warehouse for a
minimum of two (2) weeks and a maximum of three (3) weeks before returning it to the Customer.
In this respect, the applicable Terms and Conditions of Carriage and operational practices of the
relevant Partner shall prevail.
11.6. Return transportation or the stopping, recall or interception of a Consignment does not form
part of the Service.
Accordingly, neither the Service Provider nor the Partner shall be liable for any failure to carry out
such requests or for any indirect or consequential economic loss, including, without limitation,
loss of profit, loss of expected financial benefit, loss of business opportunities or interruption of
production, arising from any non-conforming performance of the Service, including damage to or
delay of the Consignment.
12. Delay, Damage to, Loss of, or Destruction of the Consignment (Force Majeure)
The rules governing delay, loss of, damage to or destruction of Consignments, the liability of the
Partners, and events of force majeure are set out in the applicable Terms and Conditions of
Carriage of the respective Partners.
13. Measures in the Event of a Claim for Damage
13.1. Only the Customer shall be entitled to submit a claim for damages to the Service Provider.
13.2. Any claim for compensation arising from shortage, loss, theft or damage to a Consignment
shall be submitted by the Customer within the following time limits:
A claim relating to a damaged or lost Consignment should, where possible, be reported
immediately upon delivery, but in any event no later than the time limit prescribed by the
applicable Terms and Conditions of Carriage of the relevant Partner and the applicable laws.
The claim must be submitted in writing to the Service Provider at info@futarlista.hu.If damage to the Consignment or its packaging is externally visible at the time of delivery, a
damage report shall be prepared jointly with the courier at the place of delivery.
Where a written claim is submitted within seventy-two (72) hours following delivery and the
Customer substantiates the claim with appropriate evidence (including photographs, the damage
report, repair or replacement invoices, or other supporting documentation), compensation shall be
assessed in accordance with the applicable Terms and Conditions of Carriage of the relevant
Partner.
13.3. Failure to submit the claim within the seventy-two (72) hour period shall result in the
forfeiture of the claim.
13.4. When shipping high-value Consignments, the Service Provider recommends that the
Customer take photographs during the packaging process and of the fully packaged
Consignment in order to demonstrate that the Consignment was properly packaged.
Such evidence shall be submitted to the Service Provider in support of any claim for
compensation.
13.5. In the event of transport damage, a damage report shall be prepared together with the
Partner's courier at the place of delivery.
Upon receipt of the Consignment, sufficient time should be taken to unpack and inspect the
Consignment in the presence of the courier in order to verify whether any damage has occurred.
13.6. All supporting documents and evidence (including photographs, transport documents, order
confirmation, a copy of the damage report, invoices evidencing the loss, and any other relevant
documentation) shall be submitted to the Service Provider within eight (8) days after notification of
the claim by e-mail to info@futarlista.hu.
13.7. The Service Provider shall reject any claim for compensation that is not accompanied by:
- photographic evidence of the damaged Consignment;
- a copy of the damage report prepared at the time of delivery; and
- a copy of the invoice or other document evidencing the value of the Consignment.
In the absence of these documents, it cannot be established that the damage occurred during
transportation, nor can the amount of the loss be determined.
13.8. No claim may be asserted against the Service Provider unless the prerequisites set out in
Clause 13.7 have been satisfied.
13.9. If the Recipient is able to demonstrate that, for reasons beyond the Recipient's control, it
was not possible to inspect the Consignment at the time of delivery, the Recipient may submit a
claim within the time limits prescribed by the applicable laws.
13.10. The Service Provider reserves the right to retain, for the purposes of further examination,
any documents relating to the Consignment that form the basis of a claim for compensation.
Where necessary for the assessment of the claim, the Service Provider or the relevant Partner
may retain the Consignment until a final decision has been made regarding the claim.
13.11. For the purposes of the compensation procedure, the Recipient shall retain all packaging
materials, as they may be required during the investigation of the claim.
13.12. Neither the Service Provider nor the Partner shall be liable for any indirect or consequential
economic loss, including, without limitation, loss of profit, loss of anticipated financial benefit, loss
of business opportunities or production downtime, arising from any non-conforming performance
of the Service, including damage to or delay of the Consignment.13.13. The Customer acknowledges and irrevocably and unconditionally agrees that any claim
arising out of the courier service, including, without limitation, claims relating to delay, shortage,
damage, loss or any other loss, may be enforced directly against the relevant Partner if the
Service Provider assigns such claim to the Customer by way of a unilateral declaration of
assignment.
13.14. The Partner and/or the Service Provider shall only compensate or credit losses that are
supported by valid documentary evidence of value, including an invoice.
13.15. The Service Provider does not provide packaging services for Consignments.
Accordingly, when assessing a claim for compensation, the Service Provider is not in a position to
determine whether the packaging of the Consignment was adequate or appropriate.
13.16. The use of a "FRAGILE" label or similar marking does not relieve the Customer of the
obligation to package the Consignment properly.
A "FRAGILE" marking serves only as a handling instruction and does not in itself protect the
Consignment against damage.
Damage to a Consignment marked "FRAGILE" shall not automatically give rise to any entitlement
to compensation.
In particular, the Customer shall carefully observe the provisions governing prohibited and
conditionally acceptable Consignments.
14. Miscellaneous Provisions
14.1. Limitation Period
All claims arising out of the courier service or the Service Agreement against either the Service
Provider or the relevant Partner shall expire one (1) year after the date of dispatch, and no such
claims may thereafter be asserted.
14.2. Governing Jurisdiction
The Parties agree that any dispute arising out of or in connection with these General Terms and
Conditions or the Service Agreement shall be subject to the exclusive jurisdiction of the District
Court for Budapest IV and XV.
